ГРОМАДСЬКО-ПОЛІТИЧНИХ ОБ’ЄДНАНЬ УКРАЇНИ

МИР — НЕ БІЗНЕСОВА УГОДА. УКРАЇНА — НЕ ПРЕДМЕТ ТОРГУ

Останні заяви Олексія Гончаренка, Данила Гетманцева та Ігоря Терехова про переговори, поступки й необхідність якнайшвидшого миру потребують принципової оцінки.

Не тому, що хтось проти миру.

Україна хоче миру більше за всіх. Бо саме Україна платить за цю війну життями своїх людей.

Але мир не може перетворюватися на бізнесову угоду, де агресор захопив чуже, а потім разом із сильнішими гравцями сідає за стіл і визначає, скільки йому залишити.

Україна — не бізнес-проєкт. Її територія — не актив для торгу. Її суверенітет — не предмет домовленостей між політиками.

Особливо небезпечно, коли така логіка починає проникати в український політичний простір під виглядом «реалізму» та «прагнення до миру».

Олексій Гончаренко прямо говорить про необхідність домовлятися з росією, взаємні поступки та переговорну модель із залученням гарантів. Данило Гетманцев також говорить про мир через переговори й результати бойових дій. Ігор Терехов закликає одночасно посилювати оборону та шукати шлях до миру.

Ми оцінюємо не їхнє право хотіти миру, а межі та наслідки запропонованого підходу.

Бо вони не просто політики.

Вони — народні депутати і посадові особи.

А це означає: їхні публічні дії та рішення мають відповідати не політичній кон’юнктурі, не чиїмось зовнішнім моделям і не логіці «хто сильніший — той і домовляється», а Конституції України, законам України та міжнародному праву.

Конституція тут абсолютно чітка.

Стаття 5 встановлює: носієм суверенітету і єдиним джерелом влади є Український народ.

Стаття 19 зобов’язує органи влади та їхніх посадових осіб діяти лише на підставі, у межах повноважень і у спосіб, передбачені Конституцією та законами України.

Стаття 73 встановлює особливий конституційний порядок вирішення питання про зміну території України.

Отже, жоден посадовець не отримував мандата самостійно вирішувати, якою має бути територія України.

І вже саме винесення питання про можливий торг українськими територіями з державою-агресором у політичний обіг є небезпечною межею, яку не можна нормалізувати під словом «мир».

Це не означає, що кожна політична заява автоматично є кримінальним правопорушенням. Але якщо публічні дії чи заклики переходять межі, встановлені кримінальним законом, вони мають отримувати належну правову оцінку.

І тут посадовцям варто згадати не лише Конституцію України.

У 2010 році в Кампалі були ухвалені поправки до Римського статуту, які визначили злочин агресії та передбачили міжнародну кримінальну відповідальність за нього і за сприяння агресору; юрисдикцію Міжнародного кримінального суду щодо цього злочину було активовано у 2018 році. Україна ратифікувала Римський статут у 2024 році, і він набув чинності для України з 1 січня 2025 року.

Це вже не політична риторика.

Міжнародне право виходить із персональної відповідальності керівників за найтяжчі міжнародні злочини.

Тому українські посадовці повинні дуже добре розуміти: посада не дає імунітету від права, а політична доцільність не скасовує юридичних норм.

І ще одна проста річ:

незнання закону не звільняє від відповідальності.

Але сьогодні нам нав’язують ще одну небезпечну підміну.

Україну намагаються втягнути в логіку, за якою війну можна врегулювати як комерційний конфлікт: домовилися, поділили інтереси, зробили взаємні поступки — і поставили крапку.

Ніт.

Росія не прийшла в Україну укладати бізнесову угоду.

Вона здійснила збройну агресію.

Тому українська політика не повинна копіювати модель, у якій долю України вирішують через баланс чужих економічних та геополітичних інтересів.

Україна — суб’єкт міжнародного права, а не об’єкт чужої домовленості.

Ми за переговори, якщо вони ведуть до справедливого, стійкого миру.

Ми за дипломатію, якщо вона зміцнює Україну.

Ми за припинення війни, якщо воно не створює передумов для нової агресії.

Але ми категорично проти того, щоб під словом «мир» нормалізували торг українською територією або політичне винагородження агресора за захоплене.

Тому звертаємося до всіх українських посадовців:

Не підміняйте український інтерес чужою політичною методичкою.

Трампівська бізнесова модель може бути чиєюсь політичною стратегією. Але Україна не може розглядатися як елемент чужої бізнесової угоди.

Це наша держава, наша земля, наш народ і наша Конституція.

Мир Україні потрібен. Але не мир ціною України, а тим, хто бере на себе відповідальність говорити про майбутнє держави, варто пам’ятати:

мандат — це не право на Україну;
посада — не право на її територію;
а прагнення миру — не право переступати через Конституцію і міжнародне право.

Український народ не делегував нікому права торгувати його державою.

Україна має право на мир, на захист і право сама визначати своє майбутнє.

І це право нікому не дозволено віддавати на чужий переговорний стіл.

STATEMENT
OF UKRAINIAN CIVIC AND POLITICAL ORGANIZATIONS

PEACE IS NOT A BUSINESS DEAL. UKRAINE IS NOT A BARGAINING CHIP

The recent statements by Oleksii Honcharenko, Danylo Hetmantsev, and Ihor Terekhov regarding negotiations, concessions, and the need to achieve peace as quickly as possible require a principled assessment.

Not because anyone is against peace.

Ukraine wants peace more than anyone else. Because it is Ukraine that is paying for this war with the lives of its people.

But peace cannot be turned into a business deal in which an aggressor seizes what does not belong to it and then sits down at the table together with more powerful players to determine how much of what it has taken it will be allowed to keep.

Ukraine is not a business project. Its territory is not an asset for bargaining. Its sovereignty is not a subject for political deals.

It is particularly dangerous when such logic begins to penetrate Ukraine’s political space under the guise of “realism” and the “pursuit of peace.”

Oleksii Honcharenko openly speaks about the need to negotiate with russia, mutual concessions, and a negotiation model involving guarantors. Danylo Hetmantsev also speaks of achieving peace through negotiations and the results on the battlefield. Ihor Terekhov calls for simultaneously strengthening Ukraine’s defense and seeking a path to peace.

We are not assessing their right to seek peace. We are assessing the limits and consequences of the approach they are proposing.

Because they are not merely politicians.

They are members of parliament and public officials.

This means that their public actions and decisions must comply not with political expediency, external political models, or the logic that “the stronger side gets to dictate the terms,” but with the Constitution of Ukraine, Ukrainian law, and international law.

The Constitution is absolutely clear on this matter.

Article 5 establishes that the Ukrainian people are the bearers of sovereignty and the only source of power.

Article 19 requires state authorities and public officials to act only on the basis of, within the limits of, and in the manner prescribed by the Constitution and laws of Ukraine.

Article 73 establishes a specific constitutional procedure for deciding questions concerning changes to the territory of Ukraine.

Therefore, no public official has been given a mandate to decide independently what the territory of Ukraine should be.

And the very act of putting the possible bargaining away of Ukrainian territories with the aggressor state into political circulation crosses a dangerous line that cannot be normalized under the word “peace.”

This does not mean that every political statement automatically constitutes a criminal offense. But where public actions or calls cross the boundaries established by criminal law, they must receive an appropriate legal assessment.

And here public officials should remember not only the Constitution of Ukraine.

In 2010, the Kampala Amendments to the Rome Statute were adopted, defining the crime of aggression and establishing international criminal responsibility for it and for acts facilitating aggression; the International Criminal Court activated its jurisdiction over the crime of aggression in 2018. Ukraine ratified the Rome Statute in 2024, and it entered into force for Ukraine on January 1, 2025.

This is no longer a matter of political rhetoric.

International law provides for the individual responsibility of leaders for the gravest international crimes.

Therefore, Ukrainian public officials must understand very clearly: public office does not provide immunity from the law, and political expediency does not cancel legal norms.

And there is one more simple principle:

Ignorance of the law does not exempt anyone from responsibility.

But today we are being confronted with another dangerous substitution of concepts.

Ukraine is being pushed toward a logic according to which a war can be settled like a commercial dispute: reach an agreement, divide interests, make mutual concessions — and put an end to it.

No.

russia did not come to Ukraine to conclude a business deal.

It launched an armed aggression.

Therefore, Ukrainian policy must not copy a model in which Ukraine’s fate is determined through a balance of other countries’ economic and geopolitical interests.

Ukraine is a subject of international law, not an object of someone else’s deal.

We support negotiations if they lead to a just and lasting peace.

We support diplomacy if it strengthens Ukraine.

We support ending the war if it does not create the conditions for another act of aggression.

But we categorically oppose attempts to normalize, under the word “peace,” bargaining over Ukrainian territory or politically rewarding the aggressor for what it has seized.

Therefore, we address all Ukrainian public officials:

Do not replace Ukrainian interests with someone else’s political playbook.

Trump’s business-oriented model may be someone’s political strategy. But Ukraine cannot be treated as an element of someone else’s business deal.

This is our state, our land, our people, and our Constitution.

Ukraine needs peace. But not peace at the price of Ukraine.

And those who assume responsibility for speaking about the future of the state should remember:

a mandate is not ownership of Ukraine;
public office is not ownership of its territory;
and the desire for peace is not a license to violate the Constitution or international law.

The Ukrainian people have delegated to no one the right to bargain away their state.

Ukraine has the right to peace.
Ukraine has the right to defend itself.
Ukraine has the right to determine its own future.

And no one has the right to place that future on someone else’s negotiating table.
